App policy

This End User License Agreement (”Agreement”) is a binding legal agreement between you (”User” or ”you”) and Quizrundan (”we,” ”us,” or ”our”). By downloading, installing, or using the Quizrundan mobile application, you agree to be bound by these terms.

1. Scope of License

We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Quizrundan app on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.

2. User-Generated Content (UGC)

Quizrundan allows you to create, post, and share quiz questions and routes (”Content”).

  • Ownership: You retain ownership of your Content, but you grant Quizrundan a worldwide, royalty-free license to host, display, and distribute it.
  • Prohibited Content: You may not post content that is defamatory, obscene, harmful, infringing on intellectual property, or promotes illegal activities.
  • Moderation: We reserve the right (but not the obligation) to remove any content that violates these terms.

3. Safety and Physical Activity

Quizrundan is a physical walking app. * Awareness: You agree to remain aware of your surroundings at all times while using the app. Do not use the app while driving or in unsafe environments.

  • Assumption of Risk: You use the app at your own risk. Quizrundan is not responsible for any physical injury, property damage, or legal disputes arising from your movement in the physical world while playing or creating quizzes.

4. Maintenance and Support

Quizrundan is solely responsible for providing any maintenance and support services for the app. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.

5. No Warranty

The app is provided ”As Is.” To the maximum extent permitted by law, Quizrundan disclaims all warranties. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.

6. Limitation of Liability

Quizrundan, and not Apple, is responsible for addressing any claims relating to the app, including:

  1. Product liability claims.
  2. Any claim that the app fails to conform to any applicable legal or regulatory requirement.
  3. Claims arising under consumer protection or similar legislation.

7. Intellectual Property Rights

In the event of any third-party claim that the app or your possession and use of the app infringes that third party’s intellectual property rights, Quizrundan, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

8. Legal Compliance

You represent and warrant that:

  • You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a ”terrorist supporting” country.
  • You are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the app (e.g., your wireless data service agreement).

10. Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
